1. INTRODUCTION

Welcome to Starlus Games! These Terms of Service ("Terms") constitute a legally binding agreement between Starlus ("Company", "we", "us", or "our") and you ("User", "Player", or "you").

By downloading, accessing, installing, or playing our games, or by accessing any of our services (collectively, the "Services"), you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. ELIGIBILITY

2.1 Age Requirement. You must be at least 13 years of age (or such other minimum age as is applicable in your jurisdiction) to access and use our Services.

2.2 Minors. If you are between the age of 13 and the age of legal majority in your jurisdiction, you represent that your legal guardian has reviewed and agreed to these Terms.

2.3 Prohibited Users. You are prohibited from using the Services if you have previously been banned by Starlus or if you are located in a country embargoed by the United States or the European Union.

3. ACCOUNTS AND SECURITY

3.1 Account Creation. You may play the game as a "Guest" or connect via a third-party service (e.g., Apple, Google, Facebook). You are solely responsible for maintaining the confidentiality of your login information.

3.2 No Ownership. You acknowledge and agree that you have no ownership or other property interest in the account. All rights in and to the account are and shall forever be owned by and inure to the benefit of Starlus.

3.3 No Account Transfer. You may not buy, sell, give, or trade any Account, or offer to do so. Any such attempt shall be null and void and may result in the termination of the Account.

4. LICENSE AND INTELLECTUAL PROPERTY

4.1 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own personal, non-commercial entertainment purposes.

4.2 Intellectual Property. All content included in the Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and game mechanics, is the property of Starlus or its licensors and is protected by international copyright laws.

4.3 Restrictions. You agree not to:

  • Copy, modify, or create derivative works based on the Services;
  • Reverse engineer, decompile, or disassemble any aspect of the Services;
  • Use cheats, automation software (bots), hacks, or any unauthorized third-party software to modify or interfere with the Service.

5. VIRTUAL ITEMS AND PURCHASES

5.1 Virtual Goods. The Service may include virtual currency (e.g., "Coins", "Gems") and virtual items (e.g., "Boosters", "Skins") (collectively, "Virtual Items").

5.2 License, Not Ownership. Virtual Items have no real-world value and cannot be redeemed for actual currency, goods, or services. You obtain a limited, revocable license to use these Virtual Items within the Game.

5.3 Purchases. All purchases of Virtual Items are processed by third-party payment providers (e.g., Apple App Store, Google Play).

5.4 No Refunds. ALL SALES ARE FINAL. You acknowledge that Starlus is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused Virtual Items when an account is closed, whether such closure was voluntary or involuntary. (Note: Refunds are generally subject to the policies of Apple and Google).

6. USER CONDUCT

You agree not to use the Service to:

  • Harass, abuse, threaten, or incite violence against other players or our staff.
  • Post or transmit content that is offensive, hateful, explicit, or illegal.
  • Disrupt the normal flow of gameplay or act in a manner that negatively affects other players.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems connected to the Service.

7. SERVICE CHANGES AND TERMINATION

7.1 Changes. We reserve the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part thereof will automatically terminate.

7.2 Termination for Cause. We may limit, suspend, terminate, modify, or delete accounts or access to the Service if you are, or Starlus suspects that you are, failing to comply with any of these Terms.

7.3 Loss of Data. Termination of your account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT THE TIMES OR LOCATIONS OF YOUR CHOOSING.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Starlus SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL Starlus'S LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM.

10. DISPUTE RESOLUTION AND WAIVER (IMPORTANT)

10.1 Governing Law. These Terms shall be governed by the laws of [Jurisdiction], without regard to conflict of law provisions.

10.2 Arbitration. Any dispute arising out of or related to these Terms shall be resolved through final and binding arbitration, rather than in court.

10.3 Class Action Waiver. YOU AND Starlus AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. CHANGES TO TERMS

We may update these Terms from time to time. If we make material changes, we may notify you by posting a notice in the Game or on our website. Your continued use of the Services after the effective date will be subject to the new Terms.
